York shall make all repairs to the asphaltic surface which may be necessary during a period of three years from the date of completion of the pavement, all defects arising through its usual use as a road- -way. It is, of course, understood that if the asphaltic surface be- -comes defective, due to a faulty foundation as built by the Hongkong Government, then such defects shall be repaird by the Hongkong Covern-

-ment underour supervision.

The Standard Oil Company shall not replace any asphaltic surface due to the road-being completely washed away by flood waters.

For maintaining this road for the period of three years, the Standard Oil Company of New York shall furnish all asphaltum and superintend all repair work. The Hongkong Government shall furnish all other materials and also the labour, machinery and conveyances for mix- -ing, transporting and applying this material.

4. Repairs to Openings. During the period of maintenance the Hong- -kong Government shall (as per directions supplied by the Standard Oil Company of New York) restore the pavement over all openings made under permits legally issued by the duly authorised official for new service connections, or repairing, renewing, or removing the same, and over all trenches made for carrying sewers, water or gas pipes or any other sub-surface pipes or conduits.

The Standard Oil Company of New York shall not be held responsible during the period of guaranty, for any defects in the pavement which may have been caused by the opening of trenches or by the improper backfilling of the same and will not be compelled to do the repaving over said trenches.

5. To avoid delay the foundation must be constructed by the Hong- -kong Government at a rate that will permit the Standard Oil Company in laying 70 cubic yards of Asphaltic mixture 2′′ thick during a period of 10 hours.
